UNION FREE SCHOOL
DISTRICT
TOWN OF OYSTER BAY
AND NASSAU COUNTY,
NEW YORK
NOTICE   IS   HEREBY
GIVEN, that a Public Hearing
      of the qualified voters
of the Massapequa Union
Free School District of the
Town of Oyster Bay, Nassau
County, New York, will be
held in the Baldwin Auditorium
          of the Massapequa
High School, 4925 Merrick
Road, Massapequa, New
York, in said District on
Thursday, May 3, 2007, at
7:00 p.m., prevailing time,
for the transaction of business
        as authorized by the
Education Law, including
the following items:
1. To present to the voters
a detailed statement (proposed
            budget)   of   the
amount of money, which
will be required for the
2007-08 fiscal year.
2.   To discuss all the items
hereinafter set forth to be
voted upon by voting machines
          at the Budget Vote
and Election to be held on
Tuesday, May 15, 2007.
3.   To transact such other
business as may properly
come before the meeting
pursuant to Education Law
of the State of New York
and   acts   amendatory
thereto.
A copy of the proposed budget
    shall be made available,
upon request, to residents
of the school district beginning
        Monday, April 23,
2007, between the hours of
8:00 a.m. and 4:00 p.m.,
prevailing time, at the Office
      of District Clerk, 4925

IS HEREBY GIVEN, that
said Budget Vote and Election
      will be held on Tuesday,
May 15, 2007, in the following
      locations: Massapequa
High School, gymnasium,
4925     Merrick     Road,
Massapequa, New York;
John P. McKenna School,
Senior   Center,   Spruce
Street and Second Avenue,
Massapequa Park, New
York; Raymond J. Lockhart
School, general purpose
room, Pittsburgh Avenue,
Massapequa, New York;
and Fairfield School, general
            purpose     room,
Massapequa Avenue and
Prospect               Place,
Massapequa, New York,
between the hours of 6:00
a.m. and 9:00 p.m., prevailing
    time, at which time the
polls will be opened to vote
by voting machine upon the
following items:
1. To adopt the annual budget
    of the School District for
the fiscal year 2007-08 and
to authorize the requisite
portion thereof to be raised
by taxation on the taxable
property of the District.
2. To adopt the annual budget
      of   the   Massapequa
Union Free School District
Public Library for the fiscal
year 2007-08 and to authorize

the requisite portion thereof to be raised by taxation

on the taxable property
of the School District.
3.   (a)   That the Board of
Education       of       the
Massapequa Union Free
School   District,   in   the
County of Nassau, New
York (the "District"), is
hereby authorized to undertake
        a facilities improvement
        project (the "EXCEL
Project") substantially as
referred to and described in
an outline prepared by the
District entitled "Proposed
EXCEL   Projects"   (the
"Plan"), which Plan is on
file and available for public
inspection in the office of
the District Clerk, said EXCEL
        Project consisting of
the construction of improvements
                  to all District
buildings, including (as and
where necessary): improvements
          to enhance accessibility
          by the physically
challenged, including the
installation of elevators in
various school buildings;
improvements to the safety
and security systems; technology
          infrastructure improvements
                  and enhancements;
          and asbestos abatement;
        all of the foregoing to
include the original equipment,
          machinery, apparatus
    and ancillary or related
site, demolition and other
work required in connection
therewith; and to expend
therefor, including preliminary
        costs and costs incidental
          thereto and to the
financing   thereof,   an
amount not to exceed the
estimated   total   cost   of
$5,747,692; provided that
the detailed costs of the
components of the EXCEL
Project as set forth in detail
in the Plan may be reallocated
        among such components
        if the Board of Education
        shall determine that
such reallocation is in the
best interests of the District;
(b) that the District (i) has
been allocated and expects
to receive $2,684,172, aid
from the State of New York
(the "State") under the new
"Expanding our Children's
Education and Learning"
(herein called "EXCEL")
aid program, and (ii) also
expects to receive other
State aid to pay the balance
of the cost of the EXCEL
Project; all of such EXCEL
and other State aid to be
received as reimbursement
to the District, by the State,
following the payment of
the cost of said EXCEL
Project by the District;
(c) that to finance the cost
of the EXCEL Project prior
to the receipt of EXCEL and
other State aid, the District
may issue short-term and
long-term obligations, and
a tax is hereby authorized
to be levied and collected in
installments in such years
and amounts as shall be
determined by the Board of
Education of the District to
pay all such obligations issued
        for such purpose as
the same become due and
payable; and
(d) the amount of taxes
hereby authorized shall be

offset and reduced by any
and all amounts of EXCEL
and other State aid received
for the EXCEL Project by
the District, and the District
      expects that the aggregate
      amount of said EXCEL
and other State aid will be
sufficient to pay substantially
        all costs of the EXCEL
        Project and substantially
        all costs of financing.
The School District has determined
              this project to be
a "Type II Action" pursuant
to the regulations of the
New York State Department
          of Environmental
Conservation promulgated
pursuant to the State Environmental
                    Quality Review
      Act ("SEQRA" and the
"Regulations"), the implementation
                of which as proposed,
          it has been determined
          as provided in said
Regulations, will not result
in any significant environmental
            effects.   SEQRA
compliance materials are
available in the office of the
School district Clerk where
they can be inspected during
    normal office hours.
4. To elect one (1) member
of the Board of Education
for a three (3) year term
commencing July 1, 2007
and expiring on June 30,
2010.
5. To elect one (1) member
of the Library Board of
Trustees for a five (5) year
term commencing July 1,
2007 and expiring on June
30, 2012.
AND FURTHER NOTICE
IS HEREBY GIVEN, that
a copy of the statement of
the amount of money which
will be required to fund the
School District's budget,
and the Massapequa Public
    Library's budget for
2007-08, may be obtained
by any resident of the District
      between the hours of
9:00 a.m. and 5:00 p.m. beginning
            Monday, April 23,
2007, except Saturday, Sunday
      or holidays, at the District
        Office, 4925 Merrick
Road, Massapequa, New
York, at each schoolhouse in
the District and at the
Massapequa   Public   Library.
AND FURTHER NOTICE
IS HEREBY GIVEN, that
petitions nominating candidates
        for the office of member
    of the Board of Education
      and member of the Library
          Board of Trustees
shall be filed with the Clerk
of said School District at
her office at 4925 Merrick
Road, Massapequa, New
York, not later than April
16, 2007, between 9:00 a.m.
and 5:00 p.m., prevailing
time.   Vacancies on the
Board of Education are not
considered separate, specific
      offices, candidates run
at large. Nominating petitions
        shall not describe any
specific vacancy upon the
Board for which the candidate
        is nominated.   Each
petition shall be directed to
the Clerk of the District;
must be signed by at least
118 qualified voters of the
District (representing the
greater of 25 qualified voters
    or 2% of the number of
voters who voted in the previous
annual election);
must state the name and
residence of each signer,
and, must state the name
and residence of the candidate.
        Vacancies on the Library
        Board are not considered
        separate, specific offices,
          candidates run at
large.   Nominating petitions
        shall not describe any
specific vacancy upon the

the District; must be signed
by at least 118 qualified
voters of the District (representing

personal registration of voters
    is required either pursuant
        to §2014 of the Education

        years, he or she is eligible
      to vote at this election.

during   school   business
hours from the District
Clerk beginning Monday,
April 30, 2007; completed
applications must be received
          by the District Clerk
at least seven (7) days before
      the election if the ballot
    is to be mailed to the
voter, or the day before the
election, if the ballot is to
be delivered personally to
the voter. Absentee ballots
must be received by the District
        Clerk not later than
5:00 p.m., prevailing time,
on Tuesday, May 15, 2007.
A list of persons to whom
absentee ballots are issued
will be available for inspection
      to qualified voters of
the District in the office of
the District Clerk on and
after Thursday, May 10,
2007, between the hours of
8:00 a.m. and 4:00 p.m. on
weekdays prior to the day
set for the annual election
and on May 15, 2007, the
day set for the election, and
said list will be posted at
the polling place(s) at the
election.   Any qualified
voter then present in the
polling place may object to
the voting of the ballot upon
appropriate grounds by

notice of the proposition to
be included with the Notice
of the Public Hearing, Budget

signed by at least 293 qualified

boilers, heating systems
and controls, and the replacement
                of windows at

          and ancillary and
related site demolition and
other work required in connection
            therewith; and to
expend therefor, including
preliminary costs and costs
incidental thereto and to
the financing thereof, an

that the estimated costs of
the   components   of   the
Project as detailed in the
Plan may be reallocated
among such components if

shall determine that such

receive EXCEL aid and any
other applicable aid from
the State of New York in a
sufficient amount to fund
said estimated total cost of
$3,886,415.00 and said EXCEL
        and other applicable
aid, as and when received,
shall be applied to pay such
cost; and
(c) that prior to and in anticipation
              of the receipt of
such EXCEL and other applicable
              aid the District
may be required to temporarily
        finance all or part of
such cost and, accordingly
a tax is hereby authorized
to be levied in installments
to pay any obligations authorized
              by said Board of
Education to be issued for
said Project prior to the receipt
        of said EXCEL aid.
The School District has determined
              this project to be

of votes shall be entitled to
the longest term and the
candidate(s) receiving the
next highest number of
votes shall be entitled, in
decreasing order of the respective
            numbers of votes,
to the several offices, in decreasing
            order of the length
of such terms or unexpired
portions of terms.

Council Appropriation budget
