MPK settles with owner of building on Park Boulevard; Village officials say restaurant and apartment now up to code

After more than a year of legal battles between the Village of Massapequa Park and a local commercial property owner, the two have struck a deal. The owner of The Irish Cottage and Pub at 1010 Park Boulevard, has agreed on a settlement that the Village says will ensure the structural integrity of the building and maintain public safety.

The Village said that the building was unsafe because there were blocked fire exits and wobbly support beams. Illegal boarding house-style apartments, with inadequate ventilation, were also found on the second floor.

According to the Village Inspector Mike Ryder, the building's owner, Adrienne C. Lynch, recently updated her commercial property after receiving several summonses about the violations totaling $1,500.

To come into compliance with Village code, the owner agreed to put in permanent basement supports and add a safe fire exit on the first floor, which houses the restaurant.

The second floor living space was returned to the two separate apartments that are permitted, with locks only on the inside doors.

The illegal apartments were discovered in December 2005 when firefighters answered a call there and discovered boarding-house style rooms with locks on the doors. There were no smoke detectors and no windows, said officials.

"Both parties are satisfied by the outcome of the case. My client is glad to be able to come into compliance and have the case over," said Lynch's lawyer, Nancy Bernheim of Davis & Bernheim.

"The Village is happy that the building is now structurally safe," said Ryder who said that the certificate of occupancy will be checked periodically to make sure problems don't resurface.
