PLAINEDGE UNION FREE SCHOOL DIS­TRICT TOWN OF OYSTER BAY COUNTY OF NASSAU, NEW YORK NOTICE OF SPECIAL DISTRICT MEETING NOTICE IS HEREBY GIVEN that a Special Dis­trict Meeting of the vot­ers of the Plainedge Union Free School District will be held at the Plainedge High School, Wyngate and Peony Drives, North Massapequa, New York on Monday, June 29, 2009 between the hours of 1:00 P.M. and 9:00 P.M., prevailing time. Voting shall be conducted by vot­ing machine on the propo­sition set forth below. PROPOSITION #1 RESOLVED that the Board of Education be and hereby is authorized to convey a portion of the former Pack­ard Middle School to the Town of Oyster Bay in con­sideration of the payment by the Town to the School District of the sum of Five Million Five Hundred Thousand ($5,500,000.00) Dollars, the demolition and removal of the Pack­ard Middle School includ­ing that portion located on property which will remain in District ownership, con­struction

by the Town of a parking lot on that portion of the property which will remain in District owner­ship, and shared usage of athletic fields to be devel­oped on the Town's portion of the property; all to be effected in substantial con­formity

with the terms and conditions of sale on filein the office of the District Clerk; and be it further

RESOLVED, that the Board of Education be and hereby is authorized to construct a combined Community Center/Athletic Facility on a portion of the former Sylvia Packard Middle School site comprised of approximately 11,000 sq. ft.and a new weight room in the High School, includ­ing

all preliminary costs, design, engineering and construction supervision expenses, labor, materi­als, original furnishings, equipment, and appara­tus required, and ancillary or related site, demolition and other work required in connection therewith, and to expend therefore an amount not to exceed the aggregate estimated maxi­mum

cost of Four Million Six Hundred Eighty Thou­sand ($4,680,000.00) Dol­lars from the proceeds of the aforesaid sale; and be it further RESOLVED, that pursu­ant to section 3651 of the Education Law, a Capital Reserve Fund to be known as the General Construc­tion Reserve Fund be es­tablished for the purpose of roof, floor, ceiling, wall, door, window and mason­ry

repair and replacement; asphalt repair and repav­ing; handicapped accessi­bility projects; plumbing, electrical, mechanical, and HVAC upgrades and re­placement; classroom, lab­oratory, auditorium, gym, locker room, athletic facil­ity refurbishment; site im­provement and landscaping refurbishment expansion and addition; computer hardware and networking upgrades and replacement; said Reserve Fund to have a probable term of ten years, an ultimate amount of Ten Million ($10,000,000.00) and to be initially funded with Eight Hundred Twen­ty

Thousand ($820,000.00) Dollars of the proceeds of the aforesaid sale and/or the transfer of unappropri­ated unreserved fund bal­ance, and thereafter from appropriations and/or the transfer of unappropriated unreserved fund balance re­maining

in the general fund during each remaining year of the probable term, such that the contribution in any one year including the ini­tial

funding shall not exceed One Million Five Hundred Thousand ($1,500,000.00) Dollars; and be it further RESOLVED, that the afore­said proposition will be summarized for the pur­pose of the ballot and vot­ing machine as follows: RESOLVED, that the Board of Education be authorized to:

1. Sell to the Town of Oyster Bay a portion of the Sylvia Packard Middle School site for the sum of $5,500,000 substantially in accordance with the terms of sale on filein the Officeof the District Clerk, 2. Construct a Community Center/Athletic Facility on the remaining portion of the Sylvia Packard Middle School site and a weight room at the High School at a cost not to exceed $4,680,000 from the pro­ceeds of said sale, 3. Establish a capital reserve fund pursuant to Educa­tion

Law Section 3651, to be initially funded with the $820,000 balance of pro­ceeds

of said sale and/or transfer from fund balance. NOTICE IS HEREBY FUR­THER GIVEN that any person otherwise qualified to vote who is currently registered to vote in an elec­tion district of the County of Nassau or part thereof whose boundaries lie with­in this school district will be entitled to vote without further registration. Unless a person is entitled to vote by virtue of such reg­istration in an election dis­trict or part thereof whose boundaries lie within the school district, pursuant to Section 2014 of the Educa­tion Law, personal registra­tion of voters is required, and no person shall be en­titled

to vote at the Special District Meeting whose name does not appear on the register of the district.

The Board of Registration of said school district will meet in the District Office,241 Wyngate Drive, North Massapequa, New York on Tuesday, June 23, 2009 between the hours of 4:00 P.M. and 8:00 P.M., prevail­ing time, at which time and place said Board of Reg­istration will prepare the register of the said school district for the aforesaid Special District Meeting and any person shall have the right to have his name placed on said register who presents himself person­ally to said Board, provided that at such meeting of the Board of Registration he is known or proven to the sat­isfaction of such Board of Registration to be then or thereafter entitled to vote at said Special District Meet­ing for which the register is prepared. The register so prepared shall also include all persons who shall have presented themselves per­sonally

for registration in accordance herewith, and all persons who shall have been previously registered hereunder for any annual or special meeting or election, and who shall have voted at any annual or special meet­ing or election held or con­ducted at any time within the four (4) calendar years prior to the preparation of the register. The register shall be filed in the Office of the Dis­trict Clerk located at 241 Wyngate Lane, North Mas­sapequa, New York, in said school district, and such register will be open for inspection by any qualified voter of said school district during regular business hours on each of the five(5) days prior to and the date set for the said Special District Meeting, except on Saturday (when it will be available for inspection by prior appointment between the hours of 11:00 a.m. and 12:00 noon) and on Sun­day. NOTICE IS ALSO GIVEN that the Board of Registra­tion

shall meet during the hours of voting on June 29, 2009 for the purpose of preparing a register for meetings or elections held subsequent to such elec­tion, and any person shall have the right to have his name placed on said reg­ister who presents himself personally to said Board and is qualified as a school district voter. NOTICE IS FURTHER GIVEN that voting by ab­sentee ballot is permit­ted and applications may be made for an absentee ballot at the Office of the District Clerk. Such appli­cation

must be received at least seven (7) days before the said Special District Meeting if the ballot is to be mailed to the voter or by the day before the said Special District Meeting if the ballot is to be delivered personally to the voter. No absentee voter's ballot shall be canvassed unless it shall have been received in the Officeof the District Clerk not later than 5:00 p.m., prevailing time, on the day of the Special District Meeting.

A list of all persons to whom absentee ballots shall have been issued will be available at the Officeof the District Clerk during regu­lar

business hours on each of the five (5) days prior to the date of the vote, except Saturday and Sunday.
