NOTICE TO BIDDERS PLEASE TAKE NOTICE that the Town of Oyster Bay, Nassau County, State of New York invites Sealed Proposals with respect to the award of:

TOBAY Beach Water Supply System Improvements TOBAY Beach CONTRACT NO. DP07-951 BID NO. PW032-09 Said proposals are to be received and stamped by the Division of Purchase and Supply of the Town of Oyster Bay at Town Hall West, 74 Audrey Avenue, 4th Floor, Oyster Bay, New York, 11771-1592, not later than 11:00 a.m. prevailing time on August 12, 2009, and immediately thereafter, all proposals will be publicly opened and read in the area as designated at Town Hall. Contract documents are available for review and procurement a the Division of Purchase and Supply of the Town of Oyster Bay at Town Hall West, 74 Audrey Avenue, 4th Floor, Oyster Bay, New York, 11771-1592, on or after July 13, 2009, between the hours 9:00 a.m. and 4:45 p.m. on regular business days, Monday through Friday. A charge of One Hundred dollars payable to the Town of Oyster Bay, non-refundable, be required for the set of contract documents. In submitting a proposal hereunder, a Contractor is required to comply with all applicable provisions of Federal, State and Local Laws. A non-mandatory pre-bid field meeting will be held on August 3rd, 2009. Contractors are recommended to attend. In accordance with Town policy, the Contractor on this project must have an apprenticeship program(s) in effect, appropriate for the type and scope of the work to be performed, approved by the New York State Commissioner of Labor, prior to entering into a construction Contract with the Town of Oyster Bay. All Subcontractors, on subcontracts of $250,000.00 or greater, must have an apprenticeship program(s) in place prior to the performance of any work on this project. If there are two or more subcontracts awarded by the General Contractor, involving one trade, and said subcontracts total $250,000.00 or greater, then all such Subcontractors must have an apprenticeship program(s) in place prior to the performance of any work on this Contract. At the time of bid submission, the Contractor shall submit with its bid proof of participation in a registered and approved NYS Apprenticeship Training Program in accordance with the Town's Rules and Regulations. If the Contractor does not submit the required affidavit and proof of participation in an Apprenticeship Training Program, the Town may declare the Contractor's bid non-responsive and award the contract to the next lowest responsible bidder. In accordance with Section 220 of the New York labor Law, all public works contracts in excess of $250,000.00 required that all laborers, workers and mechanics working on the site be certified as having successfully completed the OSHA 10-hour construction safety and health course. Subject to the foregoing, the availability of funds, and prevailing law requirements, the Town will award the contract to the lowest responsible qualified bidders.
