The foregoing Summons is served upon you by publication pursuant to an Order of Honorable W. Gerard Asher, a Justice of the Supreme Court of the State of New York, signed on the 7th day of June, 2011 at Riverhead, New York and filed on the 9th day of June, 2011 along with other papers and the Summons and Complaint in this action in the office of the Clerk of the County of Suffolk at 310 Center Drive, Riverhead, New York. The nature and the object of this action is for the Plaintiff to be adjudged the lawful owner in fee of the real property described in the Complaint by adverse possession and barring the Defendants and all persons claiming under them to any estate or interest in the real property located on the easterly side of Carroll Avenue, Peconic, Town of Southold, County of Suffolk, State of New York as more particularly described as follows: ALL that certain plot, piece or parcel of land, situate, lying and being at Peconic, Town of Southold, County of Suffolk and State of New York, being bounded and described as follows: BEGINNING at a point on the easterly side of Carroll Avenue which point is distant 368.5 feet on a tie line North 32 degrees 50’ 10” West southerly from the Long Island Rail Road (MTA) along the easterly side of Carroll Avenue and which point is the southwesterly corner of land of Dae; running thence from said point of beginning North 52 degrees 06’ 00” East along land of Dae 261.47 feet to a point; running thence North 31 degrees 30’ 40” West along the easterly boundaries of lands of Dae, Rosa-Osorino and Pace 355.24 feet to the southerly side of the Long Island Rail Road (MTA); running thence North 55 degrees 05’ 20” East along the southerly side of the Long Island Rail Road (MTA) 341.39 feet to land of Osprey Dominion Co.; running thence South 29 degrees 55’ 50” East along the westerly boundary of land of Osprey Dominion Co. 886.47 feet to land of Cichanowicz; running thence South 47 degrees 16’ 40” West along the northerly boundary of land of Cichanowicz 573.42 feet to the easterly side of Carroll Avenue; running thence North 32 degrees 50’ 10” West along the easterly side of Carroll Avenue 593.26 feet to the point or place of BEGINNING.
