Such proposal is in violation of Village Code 345-31(C) Rear and Side Yards which states; that the minimum side yard depth required in a Residential A district is five (5) feet. Also in violation of Village Code 345-40A & B (1) Fences and Similar Obstructions which states; Erection restricted. No person shall erect in any residential district of the Village a solid fence, such as but not limited to a basket weave-type fence, a solid board fence or any synthetic or metal solid fence that is greater than six (6) feet in height or is before the front house setback; nor shall there be erected in such zone any fence more than forty eight (48) inches in height, except in the rear of the front line of the house, in which case the same shall be not more than six (6) feet. Corner plots. On corner plots, the front side shall be limited to non-opaque, not solid fences no higher than fortyeight (48) inches. The street side (side yard) shall be entitled to a six (6) foot opaque (solid) fence, provided a minimum thirteen (13) foot setback from the property line is maintained. Proposed structure would have pool located five (5) feet from second front yard property line and five (5) feet behind front foundation line and be located 4.2 feet from house foundation.

The six (6) foot fence would start at the southeast corner of the house and run parallel with front foundation of house stopping at second front yard property line and then proceed along same property line with zero (0) setback and stopping at the northwest rear property line and proceed northeast within the second front yard setback. Such proposal is in violation of Village Code 345-40(B) Corner plots which states; On corner plots, the front side shall be limited to nonopaque, not solid fences no higher than forty eight (48) inches. The street side (side yard) shall be entitled to a six (6) foot opaque (solid) fence, provided a minimum thirteen (13) foot setback from the property line is maintained. Also Village Code 345- 30E Height and Area Regulations which states; Vision clearance. On any corner lot on which a front yard is required by this chapter, it shall be unlawful to construct or maintain or permit to remain any fence or any other structure, whether temporary or permanent, within thirty five (35) feet of the curb line which obstructs a view of more than thirty (30) inches above the level of the sidewalk of the adjacent street pavement. Proposed six (6) foot solid fence runs along the rear property line north and stops at second front property line and then runs west along same property line with zero setback and stops thirty five (35) feet from intersecting curb lines at which point fence will drop to four (4) foot open picket and continue to front property line.
