NOTICE IS HEREBY
GIVEN pursuant to the
provision of the State of
New York, that a Public
Hearing will be held by
the Zoning Board of Appeals in the Incorporated
Village of Massapequa
Park on Wednesday
January 16, 2013 at 8:00
PM in the Village Hall,
151Front Street, Massapequa Park, New York
11762 for the following
purposes:

Case No. 3826 To consider the variance application of Mr. Joseph
Climenti, 98 Wilson
Street, Massapequa Park,
New York 11762 to erect
a second story addition
directly over first floor
of this corner property
without the required rear
yard setback.

Such proposal is in violation of Village Code

Chapter 345-31 (B) Rear
and Side Yards which
states: Rear yards of corner lots shall be a minimum of fifteen (15) feet.
Proposed addition would
maintain the existing rear
yard setback of 8.9 feet
from rear property line.

Case No. 3827 To consider the variance application of Mr. Sandler, 115
Kings Walk, Massapequa
Park, New York 11762 to
erect a wrap around front
covered porch in violation of Village Code.

Such proposal is in violation of Village Codes:
Chapter 345-30 (D2)
Permitted Structures in
Front Yards which states:
A covered porch cannot
have a width greater than
the width of the house
to which it is attached.
Proposed porch would
extend 12.34 feet beyond
foundation. Chapter 345-
31 (A2) which states:
There must be a minimum of thirty (30) feet
between structures. Proposed

porch brings the
structure 17’-5” to the
east neighbor’s residence.
Chapter 345-31 Rear and
Side Yards which states:
The minimum depth of
side yard shall be five
(5) feet. Proposed porch
would be located 3’-6”
from side property line.

Case No. 3828 To consider the variance application of Mr. Gabriel Abbinanti, 214 Lilac Place,
Massapequa Park, New
York 11762 to maintain
an eleven (11) inch above
grade deck without the
required rear yard setback.

Such proposal is in violation of Village Code
Chapter 345-31 Rear and
Side Yards which states:
Must maintain a fifteen
(15) foot rear yard setback to all structures; existing deck located 10.69
feet to rear property line.
