PUBLIC NOTICE
The Board of Commissioners of the Massapequa
Water District has elected
to close the District’s Energy Savings Study Reserve
Fund and transfer the remaining balance of $58,501.96
into the District’s Infrastructure Reserve Fund to
facilitate repairs to its distribution system. The Resolution is adopted subject
to permissive referendum
as set forth in Town Law
Section 90. RESOLUTION AUTHORIZING THE
TREASURER TO CLOSE
THE ENERGY SAVINGS
STUDY RESERVE FUND
FOR THE PURPOSE OF
TRANSFERING THE
UNEXPENDED FUNDS
TOTALING $58,501.96 TO
THE INFRASTRUCTURE
RESERVE FUND.
WHEREAS, the Board of
Commissioners approved
appropriated funds be set
aside for the purpose of
analyzing potential energy
savings by establishing the
Energy Savings Study Reserve Fund in accordance

with§ 6-c of General Municipal Law; and
WHEREAS, effective June
26, 2013, the Energy Savings Study Reserve Fund had
a balance of $58, 501.96; andWHEREAS, the Commissioners have determined
that the underlying purpose of the Energy Savings
Study Reserve Fund has
been completed thus eliminating the need to continue
this Fund; and
WHEREAS, the Commissioners have determined
a need to increase the funding in the Infrastructure
Reserve Fund to undertake
necessary improvements
to the distribution system;
and
WHEREAS, the Commissioners have determined
that the best interests of the
District would be served by
transferring the balance of
the Energy Saving Reserves
Fund to the Infrastructure Reserve Fund pursuant
to General Municipal Law
§6-c subd. 9(a); and
WHEREAS, this resolution
is adopted subject to permissive referendum as set forth in Town Law Section 90
and shall take effect thirty
(30) days after its adoption
or, if a referendum is held,
upon the affirmative vote of
a majority of the qualified
electors of the issuer voting
on the referendum; and
WHEREAS, the funding
of capital improvement
projects in the Massapequa
Water District is a Type II
action pursuant to SEQRA
as defined by 6 N.Y.C.R.R.
§617(c) (10) and therefore
no further SEQRA review is
required; and
NOW THEREFORE,
BE IT RESOLVED, that the
Board of Commissioners
hereby authorizes the Treasurer to close the Energy
Savings Study Reserve Fund
and deposit the balance of
$58,501.96 therein into the
District’s Infrastructure Reserve Fund; and
BE IT FURTHER RESOLVED THAT the Treasurer/
Clerk is hereby authorized
and directed to, within ten
(10) days after the adoption
of this resolution, cause this
resolution to be published
in the official newspapers
of the District, and (b) posted on the sign board of
the Town of Oyster Bay and
the District’s website pursuant to Town Law, together
with a notice of adoption
thereof.
