will be held by the Zoning
Board of Appeals in the Incorporated Village of Massapequa Park on Wednesday September 18, 2013 at 8:00 PM
in the Village Hall, 151Front
Street, Massapequa
Park, New York 11762 for
the following purposes:
Case No. 3846 To consider
the variance application
of Ms. Nicole Meyer, 268
Connecticut Avenue, Massapequa Park, New York
11762 to erect on this corner property a six foot (6)
solid fence within the second front yard in violation
of Village Code. Proposed
fence to start at the N/E
corner foundation going
twenty one feet and stopping 3.91 feet from property

line and continue to
S/E property line. Also to
maintain the six foot fence
going N/W without the required 13 foot setback from
property line. Such proposal is in violation of Village
Code Chapter 345-40 (B)
corner plot which states allowed a six (6) foot fence in
the second front yard provided fence is setback 13
feet from property line.
Case No. 3847 To consider
the variance application of
Mr. Michael Campisi, 48
Fourth Street, Massapequa
Park, New York 11762 to
erect on this corner property a four (4) foot open
picket fence within the corner in violation of Village
Code. Such proposal is in
violation of Village Code
Chapter 345-30 front yards
which states allowed a four
(4) foot open picket fence
within a front yard provided you maintain a 35 foot
free line of sight measured
from the two (2) intersecting curb lines and within
this area no obstructions
greater than 30 inches above
the level of the sidewalk.
Proposed fence would be
located based on a 20 foot
free line of sight which is 15
feet less than code.
Case No. 3848 To consider
the variance application of
Ms. Jennifer Kalevas, 299
Massachusetts Avenue,
Massapequa Park, New
York 11762 to install a six
(6) foot rear solid fence and
a four (4) foot solid with a
one (1) foot slotted picket
above fence in the second
front yard in violation of
Village Code. Such proposal is in violation of Village Code Chapter 345-40
(A,B) corner plots which
states: A four (4) foot open
picket fence is only allowed
in the front yard and a six
(6) foot solid fence is allowed in the second front
yard provided a 13 foot
setback is maintained from
the property line. Proposed
fence is a four (4) foot solid
with a one (1) foot slotted
picket totaling five (5) feet
tall. Fence to start at S/E
corner of house, run S/E
21 feet and proceed N/E
to rear property line then
change to a six (6) foot solid and run N/W to property
line. The proposed six (6)
foot and five (5) foot fence
would be located 4.18 feet
from second front property
line, 8.82 feet closer than allowed by code.

Case No. 3849 To consider
the variance application
of Mr. and Mrs. Michael
Ocuto, 351 Philadelphia
Avenue, Massapequa Park,
New York 11762 to relocate an existing shed in the
rear property and install
pool filter and heater all to
be within the second front
yard in violation of Village
Code. Such proposal is in
violation of Village Code
Chapter 345-41 (J) distances which states: no pool
accessories shall be located
less than five (5) feet from
any side or rear property
line or building setback line.
Proposed location of filter,

pump and heater to be located nine (9) feet from
second front yard property
line. Also in violation of
Village Code Chapter 345-
30 (D) permitted structures
in front yards which states
the following items are permissible, encroachments; a
portico, porch, and a temporary storage container.
Proposed relocation of shed
in the second front yard
would be located three (3)
feet off property line.
