NOTICE IS HEREBY GIVEN pursuant to the provision of the State of New
York, that a Pub lic Hearing
will be held by the Zoning
Board of Appeals in the Incorporated Village of Massapequa Park on Wednesday,
July 16, 2014 at 8:00 PM in
the Village Hall, 151 Front
Street, Massapequa Park,
New York 11762 for the following purposes:
Case No. 3864 To consider
the variance application of
Mr. and Mrs. Steven Buscemi, 1328 Lake Shore Drive,
Massapequa Park, NY
11762 to maintain a built in
pool without the required
rear yard setback and to
maintain a central air conditioning unit without the
required side yard setback.
Such proposals are in violation of Village Code
Chapters 345-41 (H, J)
Pools, Walkways, Distances, which states an unobstructed walk area not less

than 24 inches wide shall be
provided to extend entirely
around pools below grade.
Also, no portion of a pool,
including walkways, pump,
filters, showers, accessories
or pool water disinfectants
shall be located at a distance
less than five (5) ft from any
side or rear property line or
building set back line. Pool
is located 1.9’ (1’10”) from
rear property line which
is 5.1’ (5’-1”) less than required by code. Walkway is
1.9’ (1’-10”) wide which is
the two (2) inches less than
required by code and has
zero (0) setback to property
line which is five (5) ft. less
than required. Proposed
relocation of pool pump/
filter to be located four (4)
ft. from rear and side property lines which is one (1)
foot less than required by
code.
Second proposal is in violation of Village Code Chapter 345-31 Rear and Side
Yard which states: Must
maintain a five (5) ft. side
yard setback. The air conditioning unit would be
located three (3) ft. to side

property line.
Case No. 3865 To consider
the variance application
of Mr. and Mrs. Jaime Rodriguez, 215 Fitzmaurice
Street, Massapequa Park,
NY 11762 to erect a first
to second story front entry
without the required front
yard setback.
Such proposal violates Village Code Chapter 345-
30(A) Front Yards which
states: Minimum required
front yard setback must be
25 ft. Proposed first to second story front entry would
be located 3.81 ft. into the
25 ft. front yard setback
leaving 21.19 ft. setback.
