the variance application

a shed in violation of Village
Code.
Such proposal is in violation
of Village Code Chapter 343-
43(B, D) Sheds which states:
Furthest point of shed, be it
the base or overhang shall
be a minimum of two (2)
feet from rear or either side
property lines. Any shed
as defined by this section
shall have a vertical height
of not more than nine (9)
feet. Existing rebuilt shed is
approximately six (6) inches
from west fence line and has
a vertical height from grade
of 10’-10”.

Such proposals are in violation of Village Code Chapter 345-30(D2) Permitted

which permits only a front
covered portico and front
porch. Chapter 345-43(C)
Sheds which states: No shed
shall be allowed to stand
in the front setback of the
house on the subject premises. Existing two (2) sheds
sit in the second front yard
first shed at 2.2’ feet and the
second shed at 3.2’ in from
the property line.

the variance application of
Mrs. Mary Scarpias, 354
Maryland Avenue, Massapequa Park, NY 11762 to
maintain a total of 5’-3” tall
solid fence with one (1) foot
lattice and a scalloped fence
in the second front yard, and
a shed too close to property
lines, in violation of Village

Code.
Such proposal is in violation of Village Code Chapter 345-40(B1) Fences and
Similar Obstructions which
states: On corner plots the
front side shall be limited
to non-opaque, not solid
fences no higher than 48”.
Existing front fence is 5’-3”
tall with the top one (1) foot
lattice. Fence starts at the
northeast corner of house
and proceeds north 12’-4”,
then proceeds east to east
property line, then proceeds
south 6’-8” and terminates at
neighbor’s fence.
Existing scalloped fence
in second front yard runs
along the south property
line starts at southwest corner of house 6’-5” tall and
scallops down to 4’-4” and
continues with this scalloping at a maximum of 4’-4”
tall. Chapter 345-43 Sheds
which states: Side and rear
setbacks must be greater or
equal to two (2) feet from
furthest portion of shed to
property line. Existing shed
is within four (4) inches of
the south property line and
within eight (8) inches to
east property line.
Case No. 4012 To consider
the variance application of
Ms. Susan Curran, 77 Second Avenue, Massapequa
Park, NY 11762 to install a
five (5) foot chain link fence
on this corner property
and to maintain a central
air conditioning unit and a
shed all in violation of Village Code.
Such proposals violate Village Code Chapters 345-
40(B1) Fences and Similar
Obstructions which states:
On corner plots, the front
side shall be limited to nonopaque, not solid fences no
higher than 48 inches. The
street side (side yard) shall
be entitled to a six 6-foot
opaque (solid) fence, provided a minimum 13-foot
setback from the property
line is maintained. Proposed
five (5) foot chain link fence
to start no further west than
the front foundation line and
run along south property
line and stopping at the east
property line. Chapter 345-
30(D1) Permitted Structures
in Front Yards which states:
The following items are permissible encroachments; a
portico, porch and a temporary storage container. Existing central air conditioning
condenser is located approximately 20.82 feet from

345-43 Sheds which states:

located less than two (2) feet
