an accessory use in a residential district in violation
of Village Code.
Such proposal violates the
following codes:
Chapter 345, Zoning Article
III General Use Regulations: Chapter 345-17B (1) Accessory uses in residential districts In connection with an
authorized professional or
customary home occupation
carried on by a person residing on the premises, there
may be displayed a small
nameplate with a simple
statement of the profession
or of the nature of the occupation; Chapter 345-17E Accessory
uses in residential districts
- Any customary home occupation, provided that the
same is carried on in the
dwelling or apartment occupied as a private residence
by the person carrying on
such home occupation and
provided further that approval therefor is obtained
from the Zoning of Appeals
of a public hearing;
Chapter 345-18 Use of part
of dwelling as place of business - It shall be unlawful to
erect, alter or use any part
or portion of a one family dwelling as a store or a
place of business, and such
use therein is hereby prohibited, except that legally
recognized occupation may
be pursued therein by such
a person residing on the
premises, as provided in
Chapter 345-17;
Chapter 345-63(A) Purpose
and intent: applicability -
The provisions set forth in
this article is intended to
encourage limited office
development of a high character and low community

impact that will be visually
and aesthetically compatible
with adjoining single-family
residence and residential
neighborhoods. This article
applies when the owner of
the premises is a professional, as set forth in 345-
64C, who does not reside in
the premises, as well as when
the premises are used by the
professional as a home-office
combination;
Chapter 345-64C(1) Permitted uses - Office of a
physician, lawyer, dentist,
accountant, chiropractor,
podiatrist or engineer duly
licensed by the state of New
York to practice as such,
provided that such office is
located in the dwelling or
house owned by said professional; and
Chapter 345-70 Height requirements - With a residential off designation, no
building shall be erected or
altered to exceed a height of
30 feet or two stories, whichever is less.
Note: Application will need
site plan approval from the
Board of Trustees if Variances are granted.
Case No.4027 To consider
the variance application of
Ms. Lauren Degen, 200 Oak

11762 to erect a six (6) foot
solid fence forward of the
front foundation and erect
same fence in the second
front yard ALL in violation
with Village Code.
Such proposal violates Village Code Chapter 345-
40(B1) Fences and Similar
Obstructions which states:
On corner plots the front
and side shall be limited
to non-opaque solid fence,
provided a minimum 13-
foot setback from the property line is maintained. The
proposed front yard fence
would extend 8.0 feet forward of front NE foundation
and then continue east to
property line and continue
south. The proposed second
front yard fence would extend 20.0 feet west from the
NW foundation stopping 5.0
feet from west property line
and continue south stopping
at south property line and
then continue east.

maintain two (2) air conditioning condensers and
proposed emergency egress

ALL in violation of Village

window to be located 4.6 feet
from west side property line
the same distance as the existing two (2) condensers.
