furthest point of a shed, be
it the base or the overhang
shall be a minimum of two
(2) feet from the rear and
either side of the property
line of the subject premises.
Any shed shall have a vertical height of not more than
nine (9) feet. Existing 10’ x
2’ shed is located at the NE

corner of yard, has a 10 inch
roof overhang all around
with a base supporting platform extending beyond shed
2’ 4” to the east property
line with zero setback. The
roof overhang is located 18
inches from same property
line. Height of shed from
grade is 10’ 9”.
Chapter 345-41(J) Distances
which states: No portion of
a pool, including walkways
and pump, filters, showers,
accessories or pool water
disinfectants shall be located
at a distance less than five
(5) feet from any side or rear
property line or building
setback line. Existing pool
deck is located 2’ 5” to south
property line.
Case No.4033 To consider
the variance application of

NY 11762 to erect a front
covered porch larger than
allowed in violation of Village Code.
Such proposal violates Village Code Chapter 345-
30(D2) Structures in Front
Yards which states: A covered porch may encroach
no greater than five (5) feet
into the 25-foot front yard
setback and cannot have
the width greater than the
width of the house. Proposed porch to extend 6.5 feet
from front of house with a
roofline which extends to 7.0
feet which provides an 18.4
foot front yard setback, 1.6
feet greater than allowed.

replace existing legal six (6)
foot stockade fence in the
second front yard with a
new six (6) PVC fence and
maintain a shed without
the required setbacks all in

Chapter 345-43 Sheds which

east of west rear property
line and 1.4 feet south of
north side property line.
