will be held by the Zoning

October 17, 2018 at 8:00 PM

New York 11762 for the following purposes:
Case No. 4103 To consider
the variance application of
Mr. Paul Oliva, 6 Glengariff
Road, Massapequa Park,
NY 11762 to maintain an
existing six (6) foot PVC
fence in the front yard and
a proposed six (6) foot PVC
fence in the second front
yard both in violation of
Village Code.
Such proposal violates the
following Village Code:
Chapter 345-40 (B1) Fences
and Similar Obstructions
which states: On corner
plots the front side shall be
limited to non-opaque, not
solid fences no higher than
48 inches. The street side
(side yard) shall be entitled
to a six (6) foot opaque
(solid) fence, provided a
minimum 13 foot setback
from the property line is
maintained. Existing six

(6) foot tall PVC fence is
located in the front yard
13 feet 5 inches from front
foundation, 16.23 feet from
property line, and then returns to east property line
and runs south along east
property line. [Note: Previous owner had a variance
#1927 in 1990 approved for
a five (5) foot stockade fence,
not passed the front foundation.] Proposed six (6) foot
PVC fence to be installed
with a zero (0) foot setback
from west property line,
keeping parallel from and
along west property line.

of Village Code.
Such proposal is in violation
of Village Code Chapter
345-31 (A) Rear and Side

setback for all structures;
existing rear yard deck is
located five (5) feet from
property line, 10 feet less
than required by code.

Such proposals are in violation of the following Village
Codes:
Chapter 345-43 (B) Sheds
which states: All sheds on
a residential property at its
furthest point base or overhang shall be a minimum of
two (2) feet from rear and
side property lines. Existing
shed is located approximately 1.5 feet from rear
property line.
Chapter 345-30 Permitted
Structures in Front Yards
which states: The following items are permissible
encroachments; a portico,
porch, emergency basement
egress well and a temporary
storage container. [Existing
mini-split located adjacent
to south foundation and
previously approved central
air unit variance #3817 in
2012.]
Chapter 345-40 (B1) Fences
and Similar Obstructions
which states: On corner
plots, the front side shall be
limited to non-opaque, not

with northwest foundation

and run to south property
line with a zero setback
and returning to southeast
property line.

replace an existing four (4)
foot chain link and four (4)

feet, stopping three (3) feet

running parallel stopping
at southwest property line.
Proposed replacement of a
four (4) foot chainlink fence
adjacent to a four (4) foot
stockade fence with a four
(4) foot solid PVC fence
starting at northwest corner
of garage proceed to and
stopping at north property
line with a zero (0) setback
and then proceed to west
property line and return
along west property line.

Such proposals are in violation of the following Village

Chapter 345-30 (A) Front
Yards which states: The required front yard setback is
25 feet. Existing foundation
is at 25.12 feet from the front
property line at its closest
point. Proposed to bump
out section at first floor by
four (4) feet bringing the
house foundation 21.03 feet
to front property line, 3.97
feet further out than code
allows.
Chapter 345-30 (D2) Permitted Structures in Front
Yards which states: A front
covered portico shall have a
width not greater than eight

(8) feet across at its base. The
roofline only may extend an
additional one (1) foot on
each end. A front portico
cannot extend more than
six (6) feet from the house
line. Proposed portico to be
located 15.13 feet to front
property line, standard setback is 19.0 feet, 3.87 feet
closer to property line than
allowed. Proposed base to
be 11.7 feet across, 3.7 feet
larger than allowed and roof
line to be 14.0 feet across,
4.0 feet wider than allowed
per code.

MASSAPEQUA FIRE DISTRICT ANNUAL BUDGET

FOR 2019
WHEREAS, on the 24th
day of September, 2018,
pursuant to Section 105 of
the Town Law and Section
181 of the Town Law the
Board of Fire Commissioners of the Massapequa Fire
District confirmed that the
Annual Fire District Budget
Hearing will be conducted
with reference to the Annual
Fire District Budget for fiscal
year 2019 on Tuesday, October 16, 2018 commencing at
7:30 p.m. at the Fire District
Administration Building

NOTICE IS HEREBY GIVEN that the aforesaid budget
will be presented to the
residents and taxpayers of
the Massapequa Fire District and to the Board of
Fire Commissioners of the
Massapequa Fire District,
for their respective consideration at this public hearing and for the purpose of
considering the said resolution and hearing all persons
interested in the subject
concerning same on Tuesday, October 16, 2018 commencing at 7:30 p.m. at the
Fire District Administration
Building located at 1 Brooklyn Avenue, Massapequa,
New York 11758.
